The case seems to be open and shut but still pending due to Pakistan’s weak judicial system

KARACHI: Almost 15 years ago in 2008, a murder took place in Pakistan. After the murder, when the state failed to arrest the accused and he fled the country, the victim’s daughter, after a 12-year search, tracked down the killer through social media in 2020. He informed the Pakistan government about this, but despite the passage of three years, the state has not been able to arrest the accused.
The case concerns the killing of the former regional head of State Life Insurance Corporation (SLIC), Muhammad Ahmed Amjad, who was shot dead 10 times inside SLIC’s office in 2008. And the accused in this case is Syed Taqi Haider Shah, former sales manager of SLIC.
A perusal of the case records shows that it is an open and shut case, but due to Pakistan’s weak judicial system, the case is pending till date and the absconding accused has not been arrested since 2008. Among the deceased, Maham Amjad, who is associated with real estate business in UAE, himself found the accused’s LinkedIn profile in 2020 while searching the internet and the accused resides in the UAE. And he started taking necessary measures in this regard. The UAE also expressed its desire to hand over the accused to Pakistan, but despite all this information, Pakistan’s Ministry of Foreign Affairs (MOFA) could not facilitate the handover of the accused from Dubai to Pakistan, raising questions. The capacity of the Pakistani mission in Dubai is being raised.
The victim’s daughter, who currently resides in Dubai, claimed that, “Taqi Shah was not the only one involved in my father’s murder, it was a pre-planned murder in which other people were also involved and they did not want it. Taqi Shah will return to the country. Maham Amjad added, “The MOFA did nothing in this case, and when I shared the copy of the extradition file sent by the Ministry of Interior of Pakistan with the Ministry of Justice of the UAE, they told me that no such file had arrived. us.”
The court will have to take the final decision about the truth of Maham Amzad’s complaint. But investigating the case has revealed details that are not only surprising but also raise serious questions in the minds of many and to understand the whole puzzle we have to go back to 2008, a month before Muhammad Ahmad Amjad was killed.
According to our investigation and research, it is clear from SLIC’s internal communication dated July 2008 that, despite all approvals, Muhammad Ahmad Amjad was not signing Taqi Shah’s application for attachment to a new area manager, causing Shah’s displeasure and pressure on Amjad. was creating A month before his murder in August 2008, he informed the company’s then management of his concerns about threats to his life. But despite this no security was provided to the victim and the accused Shah easily entered the office with a weapon and fired 10 shots at his own regional head.
It is important to note that in his letter dated August 7, 2008, Amjad wrote to the management of SLIC, clearly stating that some persons at the zonal level were instigating Shah for their personal interests. Nineteen days after the letter, Amjad was assassinated inside his office. After the incident, three employees of the company told the police at that time that Shah, another employee of the company, fired at the victim.
Following the testimony of the employees, a murder case was registered in 2008 and a non-bailable warrant was also issued for Taqi, but the police could not arrest him as he fled immediately after the murder, which led to Shah being declared absconding by the Karachi Sessions Court on May 11, 2009. Then on January 29, the Additional Sessions Judge ordered that the case be kept on inactive file till the arrest of Shah.
12 years after the murder, nothing has been found about the accused. Apparently, the state has shown no interest or according to the victim’s family, SLIC has shown no interest in the case. What is important is that Amjad’s daughter was only 15 years old when she was killed and since then she has been trying to trace the accused.
Five years ago, Maham Amjad moved to the United Arab Emirates and pursued a career in marketing and involved himself in the real estate business there. And little did he know that at that time the killer was also living in Dubai. But it is a famous saying that no matter how clever the criminal, they always leave some evidence.
And that’s exactly what happened. During his routine search in October 2020, Maham came across a LinkedIn profile, in which the name of accused Taqi Haider Shah was written, and interestingly, in that profile, Shah mentioned his work experience at SLIC. Here Maham finds the accused involved in his father’s murder after 12 years and initiates legal proceedings in Pakistan to block Shah’s passport and identity card.
But in 2022, Taqi Haider Shah got a hint of this whole thing and in November 2022 he released a video message sitting in the second holiest place for Muslims in Saudi Arabia, Masjid Nabawi. In that message, he denied the murder of Ahmed Amzad but at the same time continued to express his happiness about it. After this threatening video, Mahim Amjad filed a complaint with the Dubai authorities and according to reports, the authorities there put Taqi Haider Shah on the no travel list till the end of 2022 and then Mahim Amjad issued a red notice against Taqi Haider. Shah in support of court proceedings in Pakistan. After the Red Notice was issued, it was decided that Shah would be brought to Pakistan soon, but the behavior of the Pakistani authorities after these events was very surprising.
After the red notice was issued, the UAE authorities arrested Shah in January 2023 and then Interpol UAE wrote a letter to the National Central Bureau of Pakistan in January 2023 and said: “Taqi Haider Shah has been arrested. For his extradition to Pakistan, the extradition file must be provided within 30 days and the Arabic translation of these documents must be attested.”
Then, when Pakistan submitted the file to the UAE authorities in February 2023, on March 2, 2023, the UAE Ministry of Justice raised five objections to the file and returned it to remove the objections within 30 days. Extradition of the accused.
When this file was returned, it was circulated to various departments in Pakistan and the matter lasted from March to May. On May 29, the Ministry of Interior again cleared the objection and sent the extradition file to the Pakistani mission in Abu Dhabi and again the file was submitted to the UAE authorities, but the UAE Ministry of Justice. Again objecting to this file, it said that it does not include the request of the central authority of Pakistan i.e. Ministry of Home Affairs. And once again, this file reached the Interior Ministry of Pakistan in July 2023. Following this, Maher Mahmudi, a section officer in the Ministry of Interior, wrote a letter to the Ministry of Foreign Affairs of Pakistan and authorities in the United Arab Emirates. Emirates said on July 17, 2023: “The document that the UAE is demanding in July was sent by the Ministry of Interior and the Ministry of Foreign Affairs on May 26 and a copy is being attached.”
But surprisingly, after submitting it, the UAE again objected and sent the file back in August, this time with the same initial five objections, which were removed by the Ministry of Interior. Ministry of External Affairs in May 2023. Following this on August 25, Maher Mahmudi, a section officer in the Ministry of Interior, wrote this letter at the official level, informing all parties: “All documents required in this case have been handed over. To the Ministry of Foreign Affairs. Despite providing all the documents, some observations are coming back from the UAE, which is worrisome. The Ministry of Interior has fulfilled all the requirements in this regard and all observations of the UAE have also been addressed, and now there is no reason why this file should be sent again to the Ministry of Interior.
Following this response from the Ministry of Home Affairs, on August 31, Taqi Shah’s extradition file was again sent from Pakistan to the UAE. And on September 6, the Pakistani mission in Dubai informed the Ministry of External Affairs that there was no international arrest warrant on file. Subsequently on September 19, 2023, the Ministry of Home Affairs replied in its official letter to the Ministry of External Affairs that “the global arrest warrant has already been shared with the UAE and the Red Notice can also be accessed online”. .
And after all these circumstances, on October 23, Deputy Chief of Protocol of the Ministry of External Affairs Gian Chand submitted a statement to the Sindh High Court and the statement said: “Our mission is in constant communication with the UAE authorities. Extradition of Syed Taqi Haider Shah. A reminder has been sent to them on October 11 in this regard and the court will be informed once the response is received. At the same time, the Ministry of External Affairs also informed the court that Taqi Haider Shah was neither arrested in Abu Dhabi nor detained by the Dubai Police.
The family of the accused is complaining that after the long struggle of the daughter of the deceased Ahmad Amzad, the issue of the transfer of the accused started in January, but even after 11 months, it was not resolved till December. Deliberately done and the extradition file is being tampered with by the Pakistani authorities in the UAE.
A source of the Ministry of Home Affairs related to the case told us on the condition of anonymity, “The victim’s family has been wronged in this case. The UAE’s initial objection was valid and has been addressed. Then it is surprising to see the same objections raised again and again.” The source added: “During my posting, I have not come across a case of extradition of accused where the UAE is sending repeated objections. I don’t know why this was happening but it was not a normal practice.”
We have contacted Pakistan’s Foreign Office in this regard and sent a questionnaire regarding their incomprehensible delay and the complaint of the victim’s family.
In response, Foreign Office spokesperson Mumtaz Zehra Baloch said: “The function of the embassy is to share the case with the Ministry of Foreign Affairs for prosecution or liaison with the Ministry of Home Affairs. The Embassy cannot make any changes to the documents received from the Ministry of Home Affairs.
“The instant case was referred to the UAE Government in February 2023. After submitting the original request, both governments are engaged. We have provided all additional details to the UAE side to ensure that the extradition request complies with UAE law.
“Allegations of falsification of information and tampering with the extradition file are completely baseless as every document page in the extradition file has been attested and stamped by the concerned law enforcement agencies, Ministry of External Affairs and consular officers.
“The matter under discussion is also related to a case pending before the Hon’ble Sindh High Court. Our embassy in the UAE is following the court’s directive to the letter.”
At the same time, we sent a questionnaire to accused Taqi Haider Shah’s son Zainul Abedin, but he did not give us any reply. Apart from this, the victim’s family claims that the Rashtriya Jeevan Bima Corporation has provided facilities to the accused and his family without helping them and the accused Taqi Haider Shah has been going to office since he escaped to the UAE. State Life Insurance Corporation and working for them. We contacted State Life Insurance Pakistan and sent them a questionnaire, but they did not respond.
