The Justice Department is seeking to interrogate the two investigators Property of Donald Trump In November, federal investigators asked whether the former president had returned all classified documents to the federal government, sources familiar with the investigation told CNN.
The development is the latest sign that the Justice Department is continuing to investigate, after telling a federal court last year it believed there was potential obstruction of justice related to Trump’s handling of classified material.
Trump’s investigation continues President Joe Biden Now facing its own special counsel investigation into its handling of classified records, the two situations invite comparison. However, Biden’s investigation isn’t nearly the same as Trump’s, and questions of obstruction aren’t stuck at this point.
Special Advocate to Prosecutor Jack Smith’s The office and Trump’s defense lawyers have pushed back and forth several times over the past two months on whether Trump is fully complying with a subpoena issued last May for classified documents during his White House tenure.
That prompted Trump’s lawyer, Timothy Parlatore, to certify in writing twice that Trump’s team searched his home and office for more records. The new round of certification has not been reported before.
Some of Trump’s properties, such as his golf course in Scotland and his Las Vegas hotel, have not been searched, but Trump’s team believes they have done a thorough job, looking everywhere they believe the president may have records, sources say.
In a statement, Parlatore told CNN that the Justice Department “rejected the offer of cooperation in favor of heavy-handed tactics to create a false impression of noncompliance in the absence of evidence.”
Parlatore added: “President Trump did nothing wrong and without significant waste of taxpayer resources, a proper investigation would have ended amicably months ago.”
The Justice Department declined to comment.
Parlato told federal investigators that the former president’s legal team hired the two search Four locations before Thanksgiving and prosecutors gave a written report of what they were looking for. Trump’s team searched Trump Tower in New York, Bedminster Golf Club in New Jersey, an office location in Florida and a Florida storage unit where two classified documents were found.
The Justice Department then tried to hold Trump in contempt in a sealed court hearing on December 9, but the chief judge of the US District Court in Washington, DC, refused to do so. Instead, Chief Justice Beryl Howell suggested that the Trump team provide more information to the Justice Department, leaving the matter unresolved, according to a source.
Following the judge’s suggestion, Parlatore signed another, more detailed report on the November findings that explained why and how the locations were chosen and visited. The legal team said Trump himself has not placed any restrictions on what can be searched, a source added.
But the new report is still asking the Justice Department and prosecutors to return to court for the names of those who conducted the search, which Howell ordered the Trump team to turn over last week. The name has not been released publicly.
Written certificates from Parlato add to the evidence gathered in the ongoing criminal investigation. Last June, Trump’s lawyer Dr Christina Bob The Justice Department provided a signed statement that the Trump team conducted a “diligent search” of the boxes from the White House to Florida, and that Trump’s lawyers handed over a double-wrapped envelope of documents to federal agents.
But the DOJ found more evidence of classified records at the club that prompted them to seek a judge’s sign-off on the search. The unprecedented search of Trump’s Mar-a-Lago estate identified more than 100 records as classified, according to court filings.
It’s unclear how much Trump’s team can hold back at this stage of the investigation, as the special counsel’s office wants to speak with the investigative team. Trump’s team may try to limit some of the questions that prosecutors can ask, arguing that parts of what the investigative team knows should remain confidential as legal work product, a source said.
Federal investigators soon expressed interest in interviewing the people.
